Aydınlatma ve Açık Rıza Metni
Sanal deneme hizmetinde fotoğrafınızın nasıl işlendiğine dair bilgilendirme (Bölüm 1) ve onayınız (Bölüm 2). İki bölüm KVKK gereği ayrı tutulmuştur.

Üstünde Dene, sanal deneme teknolojisini sağlar ve fotoğrafı işleme sürecini yürütür. Taraflar arasındaki KVKK rolleri (veri sorumlusu / veri işleyen) Mağaza ile Üstünde Dene arasındaki sözleşmeyle belirlenir.

Aydınlatma Metni
KVKK m.10 kapsamında bilgilendirme. Bu bölüm onay içermez.
1. İşlenen Kişisel Veriler
- Görsel veri: Yüklediğiniz selfie veya tam boy fotoğraf.
- Fiziksel görünüm: Sanal denemenin oluşturulabilmesi için görsel üzerinde gerekli fiziksel özellikler analiz edilir. Vücut ölçüsü çıkarılıp saklanmaz.
2. İşleme Amacı
Fotoğrafınız yalnızca seçtiğiniz ürünü üzerinizde sanal olarak göstermek (deneme sonucu üretmek) amacıyla işlenir.
Fotoğrafınız reklam, profilleme, pazarlama veya yapay zekâ modeli eğitimi amacıyla kullanılmaz.
3. Biyometrik Veri Durumu
Sistem yüz tanıma veya kimlik doğrulama yapmaz; fotoğrafınız benzersiz tanımlama amacıyla işlenmez. Bu nedenle KVKK m.6 anlamında biyometrik veri niteliği taşımaz. Yine de hassas bir görsel veri olduğundan, işleme öncesinde açık rızanız alınır.
4. İşleme Yöntemi ve Yurt Dışına Aktarım
Sonucun üretilebilmesi için fotoğrafınız yapay zekâ hizmet sağlayıcılarına (Google Gemini ve OpenAI) iletilir. Bu sağlayıcıların sunucuları başta Amerika Birleşik Devletleri olmak üzere yurt dışında bulunur; fotoğrafınız yurt dışında işlenebilir.
Bu yurt dışı aktarım, KVKK m.9 uyarınca açık rızanıza dayanılarak gerçekleştirilir. Hizmet sağlayıcıların saklama, güvenlik ve kötüye kullanım denetimi uygulamaları kendi gizlilik politikalarına tabidir.
5. Saklama Süreleri

Takma adlı kimlik: kaydedilen veriler gerçek adınıza/e-postanıza değil, cihaz/oturum bazlı bir numaraya bağlanır.
6. Haklarınız (KVKK m.11)
- Kişisel verilerinizin işlenip işlenmediğini öğrenme, işlenmişse bilgi talep etme
- İşleme amacını ve amacına uygun kullanılıp kullanılmadığını öğrenme
- Yurt içinde/dışında aktarıldığı üçüncü kişileri bilme
- Eksik/yanlış işlenmişse düzeltilmesini, şartlar varsa silinmesini isteme
- Otomatik analiz sonucu aleyhinize bir sonuç çıkmasına itiraz etme
- Kanuna aykırı işleme nedeniyle zararın giderilmesini talep etme
7. Başvuru
KVKK haklarınıza ilişkin talepler Veri Sorumlusu Mağaza'ya yapılır; teknik işleyici Üstünde Dene destek olur. Fotoğraf işleme veya rıza geri çekme talepleriniz için info@üstündedene.com adresine de yazabilirsiniz.

Açık Rıza Metni
Aşağıdaki onaylar, deneme öncesinde widget üzerinde AYRI kutularla ve önceden işaretsiz olarak alınır.
Fotoğrafımın yalnızca sanal deneme sonucu üretmek amacıyla işlenmesine açık rıza veriyorum.
İşleme onayı — KVKK m.6.
Fotoğrafımın bu amaçla başta ABD olmak üzere yurt dışındaki yapay zekâ hizmet sağlayıcılarına (Google Gemini, OpenAI) aktarılmasına açık rıza veriyorum.
Yurt dışı aktarım onayı — KVKK m.9.
Her iki onay da isteğe bağlıdır ve önceden işaretli değildir; ancak sanal deneme özelliğini kullanabilmek için gereklidir. Rızanızı dilediğiniz zaman, gerekçe göstermeksizin info@üstündedene.com üzerinden geri çekebilirsiniz. Geri çekme öncesinde yapılan işlemler hukuka uygun sayılır; mağazadaki diğer özellikleriniz etkilenmez.

Privacy Notice & Explicit Consent
Information about how your photo is processed in the virtual try-on service (Part 1) and your consent (Part 2). The two parts are kept separate as KVKK requires.

Üstünde Dene provides the try-on technology and runs the photo processing. The KVKK roles (controller / processor) between the parties are defined in the Store–Üstünde Dene agreement.

Privacy Notice
Information under KVKK Art. 10. This part contains no consent.
1. Personal Data Processed
- Visual data: the selfie or full-body photo you upload.
- Physical appearance: features needed to generate the try-on are analyzed from the image. No body measurements are extracted or stored.
2. Purpose
Your photo is processed only to show the selected product on you (to generate the try-on result).
It is not used for advertising, profiling, marketing, or AI model training.
3. Biometric Status
The system performs no facial recognition or identity verification and does not process your photo to uniquely identify you. It therefore does not constitute biometric special-category data under KVKK Art. 6. As it is still sensitive visual data, your explicit consent is taken before processing.
4. Processing & International Transfer
To generate the result, your photo is sent to AI providers (Google Gemini and OpenAI). Their servers are located abroad, primarily in the United States; your photo may be processed abroad.
This transfer is carried out under KVKK Art. 9 based on your explicit consent. The providers' storage, security, and abuse-monitoring practices are governed by their own privacy policies.
5. Retention

6. Your Rights (KVKK Art. 11)
- Learn whether your data is processed and request information about it
- Learn the purpose and whether it is used accordingly
- Know the third parties to whom data is transferred at home or abroad
- Request correction or, where conditions apply, deletion
- Object to outcomes produced against you by automated analysis
- Claim compensation for damage from unlawful processing

Requests regarding your KVKK rights are made to the Store (data controller); Üstünde Dene supports as the technical processor. For photo-processing or consent-withdrawal requests you may also write to info@üstündedene.com.

Explicit Consent
The consents below are collected in the widget before the try-on, as separate, unticked boxes.
I give my explicit consent to process my photo solely to generate the virtual try-on result.
Processing consent — KVKK Art. 6.
I give my explicit consent to transfer my photo for this purpose to AI providers abroad (Google Gemini, OpenAI), primarily in the US.
International-transfer consent — KVKK Art. 9.
Both consents are optional and not pre-ticked, but are required to use the try-on feature. You may withdraw consent at any time, without reason, via info@üstündedene.com. Processing done before withdrawal remains lawful; your other store features are unaffected.
